Waycast — Terms of Use

Please read these Terms of Use (“Terms”) carefully before using Waycast (the “App”). The App is provided by Cybergeeks (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. About the App
Waycast is a personal trip-planning tool. You enter a departure point, an arrival point, and optional stops, and the App displays your route on a map together with weather forecasts estimated for the time you are expected to reach each point. The App is intended for personal, non-commercial use only.

2. Eligibility
You must be old enough to form a binding contract in your country of residence and legally permitted to use the App. By using the App, you confirm that you meet these requirements.

3. License to Use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal use and in accordance with these Terms and the Apple App Store Terms of Service. This license does not transfer any ownership of the App to you.

4. Acceptable Use
You agree not to:
– copy, modify, adapt, translate, or create derivative works of the App except as permitted by law;
– reverse-engineer, decompile, or disassemble the App, or attempt to extract its source code, except to the extent applicable law expressly permits;
– rent, lease, lend, sell, sublicense, or redistribute the App;
– remove or alter any copyright, trademark, or other proprietary notices;
– use the App in any way that is unlawful, harmful, or that interferes with its normal operation;
– use the App in violation of the terms of any third-party service it relies on.

5. Safety and Responsible Use
The App is a planning aid only. It is not a real-time navigation system and must not be used while operating a vehicle. Always follow road signs, traffic laws, and local regulations, and use your own judgment. Do not interact with the App while driving. You are solely responsible for your safety and for the safety of others while travelling.

6. Accuracy of Information
Routes, distances, travel-time estimates, arrival times, and weather forecasts are provided for general guidance and may be inaccurate, incomplete, or out of date. Weather conditions can change rapidly and may differ from any forecast. We do not guarantee the accuracy, reliability, or availability of any information shown in the App. Always verify conditions through official and reliable sources before and during your trip.

7. Third-Party Services
The App uses Apple services, including Apple Maps (MapKit) for maps and routing and WeatherKit for weather forecasts. Your use of these features is also subject to Apple’s terms and privacy policies. We are not responsible for the content, accuracy, or availability of third-party services, and we do not control them.

8. Internet and Location
The App requires an internet connection to load maps and fetch weather forecasts. Some features use your device location only when you choose to use your current position as a departure point. You are responsible for any data charges from your carrier. Please see our Privacy Policy for details on how location and data are handled.

9. Your Content
Trip plans, saved itineraries, and settings are stored locally on your device. You are responsible for this content and for keeping your own backups. We are not responsible for any loss of data, including data lost when the App is updated, removed, or reinstalled.

10. Intellectual Property
The App, including its software, design, text, graphics, and logos, is owned by Cybergeeks or its licensors and is protected by copyright and other intellectual-property laws. Except for the limited license granted above, no rights are granted to you.

11. Disclaimer of Warranties
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or available at all times.

12. Limitation of Liability
To the maximum extent permitted by law, Cybergeeks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the App. This includes any reliance on routes or weather information. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

13. Changes to the App and Terms
We may update, change, or discontinue the App or any of its features at any time. We may also update these Terms from time to time. The “Last updated” date above shows when the Terms were last changed. Your continued use of the App after changes take effect means you accept the updated Terms.

14. Termination
These Terms remain in effect while you use the App. We may suspend or end your right to use the App if you breach these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

15. Governing Law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute, to the extent permitted by law.
